- You understand that FeastForward acts as an intermediary between you and the restaurants. While we strive for excellence, we are not responsible for the quality, preparation, or accuracy of food items provided by our partner restaurants.
- You are responsible for checking the allergen information provided by restaurants and for communicating any dietary restrictions directly to the restaurant at the time of ordering.
3. Service Provision and Limitations
3.1 Our Role
FeastForward provides a platform that facilitates the ordering and delivery of food from independent third-party restaurants. We do not prepare food, nor do we employ delivery personnel. We manage the technology, facilitate payments, and coordinate with restaurants and delivery partners. Our operations are primarily based in the vibrant culinary landscape of the Lumina Valley region.
3.2 Order Processing
Once you place an order through the Service, it is transmitted to the selected restaurant for acceptance. FeastForward will notify you of the order status. In the event of any issues with your order, such as an item being unavailable or a restaurant being unable to fulfill the order, we will attempt to contact you to find a suitable resolution, which may include offering an alternative or canceling the order.
3.3 Delivery
Delivery times are estimates and are not guaranteed. Factors such as traffic, weather conditions, and restaurant volume can affect delivery times. FeastForward and its delivery partners will make reasonable efforts to deliver your order within the estimated timeframe. Delivery fees, if applicable, will be clearly displayed at checkout.
3.4 Pricing and Payment
All prices displayed on the Service are set by the individual restaurants and are subject to change. FeastForward facilitates payment processing. By completing an order, you authorize us to charge your selected payment method for the total amount of your order, including food costs, delivery fees, and any applicable taxes or service charges.
3.5 Restaurant Partners
FeastForward is not liable for the actions, errors, omissions, representations, warranties, breaches, or negligence of any restaurant or for any personal injuries, death, property damage, or other damages or expenses resulting from your interaction with restaurants through our Service.
3.6 Service Availability
We strive to ensure the Service is available 24/7, but we do not guarantee uninterrupted access. We reserve the right to withdraw or amend the Service, and any service or material we provide on the Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.
4. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of FeastForward and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FeastForward.
5. User-Generated Content
If you post reviews, comments, or submit other content to the Service, you grant FeastForward a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content you post; that the content is accurate; that use of the content you supply does not violate these Terms and will not cause injury to any person or entity; and that you will indemnify FeastForward for all claims resulting from content you supply.
6. Third-Party Links
Our Service may contain links to third-party web sites or services that are not owned or controlled by FeastForward. FeastForward has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that FeastForward shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
7. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. FeastForward expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
FeastForward makes no warranty that:
- the Service will meet your requirements;
- the Service will be uninterrupted, timely, secure, or error-free;
- the results that may be obtained from the use of the Service will be accurate or reliable;
- the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations;
- any errors in the Service will be corrected.
8. Limitation of Liability
In no event shall FeastForward, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- your access to or use of or inability to access or use the Service;
- any conduct or content of any third party on the Service;
- any content obtained from the Service;
- unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
In no event shall FeastForward's aggregate liability to you for all claims arising out of or related to the Service exceed the greater of the amount you have paid to FeastForward for use of the Service in the past twelve (12) months or $100.00 USD.
9. Indemnification
You agree to defend, indemnify and hold harmless FeastForward and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), arising from:
- your use of and access to the Service;
- a breach of these Terms by you;
- any content posted on the Service by you;
- your violation of any third-party right, including without limitation any copyright, property, or privacy right;
- any claim that your content caused damage to a third party.
This defense and indemnification obligation will survive these Terms and your use of the Service.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. The parties agree to submit to the personal and exclusive jurisdiction of the federal and state courts located within the State of California for the resolution of any disputes arising from or related to these Terms or the Service. 12. Termination
